NICK NOLTE was down and out in Malibu Wednesday.

　　The two-time Oscar nominee was jailed after being arrested for investigation of being under the influence of alcohol or drugs, the California Highway Patrol said.

　　Nolte, 61, was spotted swerving on the Pacific Coast Highway, at one point allegedly pulling his Mercedes into the opposing traffic lane.

　　“The officer stopped the vehicle and found that Nolte at that point seemed completely out of it,” CHP spokesman Leland Tang said.

　　“He was drooling, (with) droopy eyes. He...looked very much like he was under the influence,” said Tang.

　　The star of Affliction and Down and Out is expected to post US$2,500 bail and be released later Wednesday evening.

　　Nolte’s publicist, Arnold Robinson, had no immediate comment.
