Worker wins compensation
|
SHENZHEN Municipal Intermediate Court recently ruled that a SZ-based fur textile manufacturer should pat former worker Liu Tao, who lost her arms in a workplace accident, 1.58 million yuan in compensation, in what is believed to be the largest-ever award in an industrial injury case.
Migrant worker Liu Tao lost her arms in 1998. Initial labour arbitration and preliminary court rulings saw her compensation award rise from 41,810 yuan to 1.33 million yuan and finally to 1.55 million yuan.
However, Zhou Litai, Liu's lawyer, claimed that the payment procedure spelled out by the court did not guarantee Liu's legal interests, and vowed to appeal to the Guangdong Provincial Supreme Court.
The court ruled that the 1.55 million yuan should be paid out in two sections. The manufacturer will have to pay Liu a lump sum of 506,898 yuan, then the rest in twice-a-year payments.
The lawyer pointed out the manufacturer is subject to market risk and possible bankruptcy, and thus the compensation may not be paid in full.
